• MyLib Terms of Use

    These "Terms Of Use" govern your use of the MyLib Service either through Website or any MyLib Store, hereinafter referred to as "Service". The Service is owned and operated by MyLib and is offered to you (hereinafter referred to as "Member") as per your agreement with and acceptance of this document (hereinafter referred to as "Membership"). By clicking the box entitled "I Have Read and Accepted The Terms Of Use" as part of the registration process, Members accept all items in the Terms & Conditions and agree to abide by and be legally bound by the Terms & Conditions.

  • Changes to Terms of Use

    MyLib, reserves its right, from time to time, with or without notice to you, to change these Terms & Conditions in our sole and absolute discretion. The most current version of these Terms & Conditions will supersede all previous versions and can be reviewed by clicking on the "Terms & Conditions" located at home page of the MyLib Website.

  • Privacy

    On registering at MyLib you are asked for your personal information. This information is used for processing your orders and to communicate with you about the status of your orders. At the time of membership application, MyLib will send a verification code by SMS to the member's mobile phone. Only after the successful verification of the mobile phone will the application be accepted. Messages/ updates about Mylib special offers, promotional announcements and consumer surveys shall be received by you on your email or telephone. Except as described in this section, we will not sell, rent or disclose your personally identifying information to third parties without notifying you of our intent to share the information and giving you an opportunity to prevent your information from being shared.

  • Rent Limit

    There are no due dates on books rented for plans which has a no rent limit. However, books asked to be returned by MyLib for any reason needs to be returned within 7 days of the request after which additional fees would be levied. MyLib has the right to take these additional charges from the refundable deposit of the member. For Pay Per Book Plans, time limit is applicable and late fee will be levied for books which are kept beyond the due date.

  • Billing

    By using the MyLib service, you are expressly agreeing that we are permitted to bill you subscription fee on recurring basis as per plan chosen, any applicable tax and any other charges you may incur in connection with your use of the MyLib service. In scenarios where the member do not pay the charges within 7 days of billing, the amount will be deducted as applicable from the member's refundable deposit. All fees and charges are non-refundable. We may change the fees and charges in effect, or add new fees and charges from time to time, but we will give you advance notice of these changes by either email or by posting changes on Website.

  • Damaged books

    If any book is damaged, you can replace the book (within 7 days) OR pay MRP of the cost of the book if the book is available in Bangalore. If the book is not available in India the customer will be charged twice the MRP. The cost of the damage and the extent of the damage will be decided at the sole discretion of MyLib

  • Cancellations

    You may cancel your membership with MyLib at anytime by calling in or by filling up the cancellation form at our store. We issue a refund of the security deposit within seven working days to the member or to the person who is authorised in writing by the member. Before cancellation, you are required to return any outstanding books. Failure to return such books will be charged to your refundable security deposit. Any unbilled charges or unbilled membership period will also be charged to your refundable security deposit. MyLib reserves the right to terminate your membership for any or no reason at its sole discretion.

  • Piracy

    MyLib takes utmost care to keep only the original copies of all books. In case you find any book in MyLib which you feel is pirated, please inform us immediately or write to us at cs@mylib.in.

  • Referral Program

    All members who register with the services of MyLib shall automatically become members of the Referral Programme. Members of these programmes will accrue benefits by referring new members to the service according to the latest programme. A member who has closed his account will not be eligible for the referral program

  • Termination of membership

    MyLib may terminate your Membership without prior notice of your Material Breach of this agreement. "Material Breach" includes: (a) Any violation of any of the provisions of this agreement (b) Acting unlawfully in relationship to MyLib or the website. (c) If there is a breach of our Anti-Spam Policy. (d) For providing incomplete, false, bogus or otherwise incorrect information to us. (e) Creating duplicate or illegal Memberships. If your Membership is terminated due to Material Breach of this agreement, as provided above, your accrued reward benefits will be forfeited, and you will not accrue any further reward benefits following your termination.

  • Disclaimers of Warranties and Limitations on Liability

    The MyLib service and Website and its contents are provided "as is" and we make no representations or warranties of any kind with respect to the MyLib Website, its contents or our service. We assume no liability or responsibility for any errors or omissions in the content of the MyLib Website, any failures, delays, or interruptions in the shipment of books, delivery of any content contained on the MyLib Website, any losses or damages arising from the use of the content provided on the MyLib Website, or any conduct by users of the MyLib service or Website. We reserve the right to ship books in our sole and absolute discretion. We disclaim all representations and warranties, including, for example, warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, we do not represent or warrant that the information accessible via our site is accurate, complete or current. In no event shall MyLib, its shareholders, directors, officers, or employees be liable (jointly or severally) to you for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of the MyLib Website, its contents or our service. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.

  • Intellectual Property

    All content included on the MyLib Website and delivered to subscribers as part of the service, including books, text, graphics, logos, designs, photographs, button icons, images and software, is the property of MyLib, or its suppliers and is protected by the Indian and international copyright laws. The compilation of all content on this site is the exclusive property of MyLib, and protected by the Indian and international copyright laws. Content shall not be reproduced or used without express written permission from MyLib, or its suppliers. You agree not to decompile, reverse engineer or disassemble any software or other products or processes accessible through the MyLib Website, not to insert any code or product or manipulate the content of the MyLib Website in any way that affects the user's experience, and not to use any data mining, data gathering or extraction method. MyLib reserves the right to terminate your membership hereunder if MyLib, in its sole and absolute discretion, believes that you are in violation.

  • Use of Information submitted

    MyLib, is free to use any comments, information, ideas, concepts, reviews, or techniques or any other material contained in any communication you may send to MyLib ("Content"), including, without limitation, responses to questionnaires or through postings to the MyLib Website without further compensation, acknowledgement or payment to you for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products and creating, modifying or improving the MyLib Website or other Websites. Furthermore, by posting any Content on our site, submitting Content to us, or in responding to questionnaires, you grant us a perpetual, non-exclusive, royalty-free irrevocable license and right to display, use, reproduce or modify the Content submitted in any media, software or technology of any kind now existing or developed in the future.

  • Limitations of Use

    Unless otherwise specified, the content on the MyLib Website is for your personal and non-commercial use and we grant you a limited license to access the MyLib Website/Stores for that purpose. You may not download (other than through page caching necessary for personal use), modify, copy, distribute, transmit, display, perform, reproduce, duplicate, publish, license, create derivative works from, or offer for sale any information contained on, or obtained from, the MyLib Website without our express written consent. Any unauthorized use of the MyLib Website or its contents will terminate the limited license granted by us.

  • Arbitration:

    All disputes arising out of or in relation to these presents, during its subsistence or/and after its termination in any manner whatsoever, including the validity of this Privacy policy or interpretation of any provision hereof, shall, unless resolved amicably by and between the Parties hereto, be referred to an arbitration in accordance with the provisions of in the Arbitration and Conciliation Act, 1996 or any re-enactment or modification thereof. The parties shall refer the dispute to a sole arbitrator appointed by both the parties. The place of Arbitration shall be Bangalore and the language of Arbitration shall be English.
